These Terms & Conditions apply to services provided by Moreish Studios, including recording, music production, mixing, mastering, editing, audio post-production and related audio services.
By confirming a booking or quote, paying an invoice or deposit, supplying material for work to begin, or otherwise instructing Moreish Studios to commence a service after being provided with these Terms, you agree to be bound by them.
Any quote, invoice, project agreement, Music Production Release Agreement or other written agreement supplied for a particular project may contain additional terms. Where a specific written project agreement conflicts with these general Terms, the specific written agreement will apply to that project to the extent of the inconsistency.
Moreish Studios provides recording, production, mixing, mastering and related audio services.
Recording sessions attended by clients, artists, musicians or guests are conducted at Lily Street Studios, 8 Lily Street, Coburg North VIC 3058, unless another location has been specifically agreed to in writing.
Moreish Studios also operates a private Post Production Studio used for mixing, mastering, editing and other post-production work.
The Post Production Studio is not a client-access facility. For operational, privacy and insurance reasons, clients, artists, guests and other visitors are not permitted to attend the Post Production Studio unless Moreish Studios has expressly agreed otherwise in writing.
Mixing, mastering and other post-production services are therefore normally conducted remotely, with files, previews, feedback and approvals exchanged electronically.
There is no casual recording-studio tier or casual client access to the Post Production Studio.
Quotes are prepared using the information available at the time and are based on the agreed scope of the project.
The quoted price covers only the services, deliverables and work reasonably described in the quote, invoice or project correspondence.
Additional work may include, for example, substantial editing, vocal tuning, comping, file repair, additional recording, new stems or files supplied after work has commenced, arrangement changes, additional versions, alternate masters, additional musicians, substantial changes in creative direction, additional revision rounds or work otherwise outside the original scope.
If a material change to the scope is requested, Moreish Studios will advise the client of any additional cost before undertaking that additional work wherever reasonably practicable.
Where a project is being completed in stages, such as Recording → Production → Mixing → Mastering, each stage may be treated and invoiced separately.
All prices and payments are in Australian dollars unless stated otherwise.
Invoices must be paid in accordance with the payment terms shown on the invoice or agreed in writing.
For projects completed in stages, Moreish Studios may require payment for one stage before beginning the next stage. For example, payment for recording may be required before mixing begins, and payment for mixing may be required before mastering begins.
Moreish Studios may pause work on an overdue account until the outstanding amount has been paid.
Release-ready final files may be withheld until all amounts relating to the relevant service have been paid in full.
Any card-processing fee or other payment fee, where applicable, will be disclosed before payment and will only be charged to the extent permitted by applicable law and payment-provider rules.
Approved third-party expenses, including studio hire, session musicians, specialised equipment, external contractors or other project costs, are payable by the client as agreed.
A recording booking reserves a particular period of studio and engineering time.
Clients should arrive ready to commence at the agreed booking time. A late arrival does not automatically extend the booked finishing time.
Additional time may be made available where scheduling permits and may incur an additional charge at the applicable rate.
Artists, musicians and guests attending Lily Street Studios must follow reasonable instructions relating to studio operation, equipment, safety and venue requirements.
Moreish Studios may refuse or stop a session where behaviour is threatening, abusive, seriously disruptive, unsafe, unlawful, or creates an unreasonable risk of damage to people, equipment or the premises.
Where a session is stopped for one of these reasons, the client remains responsible for the services already provided and any reasonable costs that cannot be recovered.
Anyone under 18 attending a session must have the permission of a parent or legal guardian and may be required to attend with an appropriate responsible adult.
The person making the booking is responsible for the conduct of the artists, musicians and guests they bring to a recording session.
Attendance must remain within the safe and reasonable capacity of the booked studio and may be limited where necessary.
The private Moreish Studios Post Production Studio is not available for client attendance, guest attendance, listening sessions, tours or unarranged visits.
If you need to cancel or reschedule a Lily Street recording booking, please provide as much notice as reasonably possible.
For cancellations or rescheduling made less than 24 hours before the scheduled session, the client may be required to pay the Lily Street studio hire charge and any other reasonable third-party or non-recoverable costs already incurred in connection with the booking.
Moreish Studios will not charge an amount that is intended simply to penalise a client for cancelling.
Where reasonably possible, Moreish Studios will attempt to minimise cancellation losses, including by rescheduling or rebooking studio time.
For remote production, mixing, mastering or post-production projects that have already commenced, a client who decides not to continue may still be required to pay for work already completed and reasonable costs already incurred.
If Moreish Studios needs to cancel a booked service, we will normally offer a suitable rescheduled time. If the service cannot reasonably be rescheduled, any amount paid for services that have not been provided will be dealt with fairly and in accordance with applicable law.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
Clients are responsible for providing files in a suitable format and for following any relevant preparation instructions supplied by Moreish Studios.
The client should retain their own backup of all recordings, sessions, stems, mixes, masters and other material supplied to Moreish Studios.
Moreish Studios is not intended to be the client’s sole backup or long-term archive.
If files are incomplete, corrupted, incorrectly exported, missing, technically unsuitable or materially different from what was originally described, additional preparation or repair work may be required before the project can proceed.
The client retains ownership of copyright and other rights they already hold in material supplied to Moreish Studios.
Supplying material to Moreish Studios does not, by itself, transfer ownership of that material to Moreish Studios.
The client confirms that they have the authority and necessary permissions to supply and use the material provided for the project.
This includes, where relevant, permission to use recordings, performances, beats, samples, instrumentals, compositions, lyrics, loops, artwork or other third-party material.
The client is responsible for clearing any third-party material required for the intended release or commercial use of the project.
Moreish Studios is not responsible for a copyright or ownership dispute caused by material supplied without the necessary authority or permission.
Music production may involve creative contributions beyond engineering, including songwriting, composition, arrangement, programming, instrumental performance or other original creative contributions.
Where Moreish Studios, Shane Jarvie-Kohn, another producer, songwriter or session musician contributes material that may attract separate songwriting, publishing, performer or other rights, those rights are not automatically transferred merely because the client has paid a studio or production fee.
Production projects may therefore be subject to a separate Music Production Release Agreement, split agreement, musician agreement or other written arrangement.
Any agreed songwriting shares, publishing interests, royalties, credits or other rights should be confirmed before release wherever possible.
Where there is a conflict between these Terms and a specific signed or accepted Production Release Agreement, the Production Release Agreement will govern those production-specific rights.
The final deliverables are the files or materials specifically included in the agreed service or quote.
Unless specifically agreed otherwise, the quoted service does not automatically include every working file generated during the project.
Items such as Pro Tools sessions, DAW project files, unused takes, alternate edits, raw recordings, individual multitracks, processing chains, plugin settings, hardware recall information, stems, alternate masters and other working materials may require additional preparation and may not be included in the standard delivery.
If you require particular stems, session files or alternate versions, please request them before the project is completed so their availability and any additional cost can be confirmed.
Some project files rely on software, plugins, licences, hardware or systems belonging to Moreish Studios and may not reproduce identically on another system.
Draft mixes, revision mixes, sample masters, work-in-progress versions and other previews are supplied for evaluation and approval only unless Moreish Studios confirms that they are final deliverables.
They must not be commercially released, distributed, uploaded for public consumption or represented as final Moreish Studios work before the relevant service has been approved and paid for in full.
Evaluation versions may contain limitations, interruptions, watermarks, reduced quality or other measures designed to distinguish them from a final release-ready file.
Where a complimentary or private mastering preview is offered, its purpose is to allow the client to evaluate the proposed mastering direction. It is not itself a release-ready master.
Unless otherwise stated in the quote, Moreish Studios mixing includes up to two major revision rounds.
A revision round means one reasonably consolidated set of feedback supplied after reviewing the current version.
Clients working as a band, label, management team or other group should coordinate feedback internally and provide one consolidated set of instructions through the nominated project contact wherever possible.
Normal in-scope mix revisions may include matters such as level changes, balance adjustments, reasonable effect changes or correction of an agreed request that has not been implemented as intended.
A revision does not normally include a substantially new creative direction, new or replacement recordings, new stems, arrangement changes, extensive additional editing, rebuilding a mix around newly supplied material, reprocessing material through analogue equipment after recall has been broken, or creating substantially different alternate mixes.
Those requests may be quoted as additional work.
Once a mix has been approved, the included revision stage is considered complete. Later changes may incur an additional fee.
Reasonable minor corrections may be accommodated at Moreish Studios’ discretion where they remain within the original project scope.
Mastering revisions are provided in accordance with the service quoted or advertised at the time of booking.
A mastering revision is intended to address the mastering treatment of the supplied mix.
If the client changes the underlying mix after mastering has been completed, the new file may require a new mastering pass or remaster and may incur the applicable remastering fee.
Stem mastering revisions may likewise incur additional charges where replacement stems, new balances or materially changed source files are supplied.
Because production projects vary substantially in scope, included production revisions will be determined by the relevant quote or project agreement.
A substantial change of arrangement, instrumentation, songwriting direction or production concept after work has been completed may be considered new work rather than a normal revision.
Moreish Studios will discuss any significant additional cost before proceeding wherever reasonably practicable.
Audio production, mixing and mastering involve professional judgement as well as subjective creative preference.
Reference tracks and examples supplied by a client are used to communicate musical direction, taste, tone or production objectives. They are not a promise that Moreish Studios will reproduce another recording exactly.
Differences in performers, arrangements, recordings, instruments, source material, acoustics and production choices mean that two recordings cannot necessarily be made identical.
Moreish Studios will provide its services with appropriate professional care and skill but cannot guarantee commercial success, streaming performance, radio play, chart placement, label interest or any other particular commercial outcome.
Turnaround times are estimates unless a specific deadline has been expressly agreed in writing.
Clients should disclose important release dates or external deadlines before work begins.
Moreish Studios is not responsible for delays caused by late file delivery, missing material, delayed feedback, additional client-requested work, third-party services or other matters outside Moreish Studios’ reasonable control.
A release or promotional campaign should not be scheduled on the assumption that unfinished work has been finally approved unless an appropriate delivery deadline has been confirmed.
Rush work is subject to availability and may attract an additional fee where disclosed and accepted in advance.
For projects involving multiple band members, artists, managers, labels or other stakeholders, Moreish Studios may ask that one person act as the authorised project contact.
Moreish Studios is entitled to rely on instructions and approvals supplied by that nominated person unless advised otherwise in writing.
Disagreement between members of a band, creative team or other client group does not automatically create additional included revision rounds.
If conflicting instructions are received, Moreish Studios may pause the project until clear instructions are provided.
Moreish Studios uses reasonable care when handling project files and ordinarily aims to retain working project material for at least six months after final delivery.
This retention is provided as a courtesy and should not be treated as a permanent archival or backup service.
Clients should download final files promptly and maintain their own secure backups.
After the normal retention period, Moreish Studios may archive or delete project material without notice.
If an older project needs to be restored, reopened or transferred from archive, additional fees may apply depending on the work required and whether the files remain available.
Clients and their guests must take reasonable care when using studio equipment, instruments and facilities.
The client may be required to pay reasonable repair or replacement costs for equipment or property damaged through deliberate misuse, negligence or inappropriate conduct by the client or their guests.
Normal wear and tear is excluded.
Clients are responsible for looking after their own instruments, devices, drives and personal property while attending a session.
Nothing in this clause excludes liability that cannot lawfully be excluded.
Moreish Studios understands that unreleased recordings and project material may be commercially or personally sensitive.
Moreish Studios will not intentionally publicly release, sell or commercially exploit a client’s unreleased music without permission.
Project files may be accessed where reasonably necessary by people involved in completing the project, such as approved engineers, producers, session musicians, contractors or service providers.
If a project requires a specific non-disclosure agreement or heightened confidentiality arrangement, this should be discussed and agreed in writing before work begins.
Once a project has been publicly released by the artist, label or authorised party, Moreish Studios may identify the project as part of its professional credits or portfolio and may link to or embed an official publicly available release, unless otherwise agreed.
Where reasonably applicable, clients are expected to provide accurate professional credit for the work performed by Moreish Studios and its personnel.
Examples may include:
“Mixed by Shane Jarvie-Kohn at Moreish Studios”
“Mastered by Shane Jarvie-Kohn at Moreish Studios”
“Recorded by Shane Jarvie-Kohn at Lily Street Studios”
Production, songwriting, performance and other creative credits will depend on the contributions made to the project and any relevant Production Release Agreement or other written agreement.
Promotional offers, membership discounts, referral discounts and promotional codes may have additional conditions.
Unless an offer specifically states otherwise, discounts cannot be combined.
Proof of eligibility may be required for membership or affiliate discounts.
The conditions advertised for a particular promotion at the time of booking form part of these Terms for that booking.
Personal information is handled in accordance with the Moreish Studios Privacy Policy and applicable privacy requirements.
Audio files and project materials supplied for professional work are used for purposes reasonably connected with providing the requested services, administering the project and maintaining appropriate business records.
Moreish Studios does not normally provide a refund merely because a client changes their mind after agreed work has been performed.
Where a project is cancelled after work has commenced, the client may be charged for work already performed and reasonable costs already incurred.
However, these Terms do not exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.
Where a service fails to comply with a non-excludable consumer guarantee, the client may be entitled to a remedy available under applicable law.
Nothing in these Terms should be interpreted as stating that refunds are never available regardless of the circumstances.
Occasionally a session or project may be affected by circumstances reasonably outside Moreish Studios’ control, such as serious illness, power or network failure, equipment failure, venue closure, emergency, natural event or another unexpected disruption.
Where this materially affects a booked service, Moreish Studios will make reasonable efforts to minimise the impact and, where appropriate, offer a rescheduled service, alternative arrangement, credit or refund for an undelivered portion of the service.
Moreish Studios is not responsible for delays caused by events it could not reasonably prevent, but this does not remove any rights or remedies that apply by law.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
To the extent permitted by law, Moreish Studios is not responsible for losses arising solely from matters outside its reasonable control or from a client’s failure to follow agreed instructions, obtain required permissions, maintain backups or provide accurate project information.
Clients should not delete their original material or rely on Moreish Studios as their only copy of important recordings or files.
Moreish Studios may update these Terms from time to time to reflect changes to services, business practices or legal requirements.
Unless otherwise agreed, the Terms applying to a project are the version provided or publicly available when that project or booking was accepted.
A later change to these Terms will not retrospectively change an existing project agreement without agreement where doing so would materially affect the client’s rights or obligations.
If a concern or dispute arises, both parties are encouraged to first communicate directly and make a genuine attempt to resolve the matter reasonably.
These Terms are governed by the laws applicable in Victoria, Australia, subject to any mandatory consumer rights or other laws that apply to the client.
Nothing in these Terms prevents a client from exercising rights available through Consumer Affairs Victoria, the Australian Consumer Law, a court, tribunal or another lawful dispute-resolution process.
